1- Assumption of Risk

I, the undersigned, acknowledge and agree that my participation in activities at SANTAI including but not limited to using saunas, cold plunges, and other related facilities (the “Activities”) involves inherent risks. These risks include but are not limited to:

Temperature extremes: Potential exposure to extremely hot or cold temperatures, which may result in burns, hypothermia, frostbite, or other heat or cold-related injuries.
Physical strain: Sudden changes in temperature or humidity levels can cause dizziness, fainting, or loss of balance.
Water-related hazards: Drowning, slipping, or falling in or around wet areas.
Medical conditions: Pre-existing medical conditions may be aggravated by the heat or cold, and it is my responsibility to consult a healthcare provider before participating.
I voluntarily accept and assume all risks associated with my use of the facilities and participation in the Activities.

2- Waiver and Release of Liability

I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby waive, release, and forever discharge SANTAI, its owners, officers, employees, agents, contractors, and affiliates from any and all liability, claims, demands, actions, or causes of action arising from any injury, illness, damage, or loss sustained by me during or as a result of my participation in the Activities, whether caused by negligence or otherwise.

3- Indemnity Agreement

I agree to indemnify, defend, and hold harmless SANTAI, its owners, officers, employees, agents, contractors, and affiliates from and against any and all claims, liabilities, losses, damages, expenses, including attorney’s fees, arising from or in connection with my participation in the Activities, including but not limited to claims arising out of my negligence or willful misconduct.

4- Medical Treatment Authorization

In the event of an injury or emergency, I authorize SANTAI and its representatives to seek emergency medical treatment for me if deemed necessary. I agree to bear any costs associated with such treatment.

5- Acknowledgment of Understanding

I have read this Assumption of Risk, Waiver and Release of Liability, and Indemnity Agreement, and fully understand its terms. I understand that by signing this document, I am giving up substantial rights, including my right to sue, and I acknowledge that I am signing the agreement freely and voluntarily.

6- Severability Clause

If any part of this agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remainder shall remain in full force and effect.

7- Third-Party Persons

I acknowledge that if I acquire services, goods, or access to the Activities on behalf of third-party persons (e.g., guests, family members, or other individuals), I am responsible for ensuring that such third parties are fully informed of and agree to the terms of this Agreement. I agree to assume all risks and liabilities associated with the participation of these third parties in the Activities, and I waive, release, and indemnify SANTAI, its owners, officers, employees, agents, contractors, and affiliates from any claims, damages, or losses arising from the actions, injuries, or participation of these third parties, whether caused by negligence or otherwise.
